Lohan Lockdown Loophole: No Rehab Might Mean Jail Time
One stipulation of the plea deal struck by Lindsay Lohan's lawyer and prosecutors in Los Angeles is that the starlet spend 90 days in a lockdown rehabilitation facility, however a bit of a loophole might mean that doesn't happen...and, in turn, that could mean jail time for the actress.The sleuths over at TMZ have determined that in New York, "rehab facilities do NOT force patients to stay," and: "In fact, an official from the New York State agency that regulates rehab facilities tells us lockdown rehab does not exist in NY."
Apparently NY is where LiLo is planning to do her rehab-ing, and her NY-based lawyer (who has taken a helluva lot of heat from the L.A. judge about his NY-centric flubs practicing law in California) Mark Heller had secured the plea deal by assuring prosecutors there were, indeed, lockdown rehab facilities in New York.
That's kind of a big oops, for both Lohan and Heller. Rumor has it prosecutors are looking into whether Heller deliberately misinformed them about lockdown rehab, and if those facilities really don't exist in NY, that might be what (finally) sends Lohan to the slammer. A law enforcement source told TMZ: "The sentence was actually 90 days in custody, and lockdown rehab would satisfy that. If there's no such thing, then she'll go to jail for 90 days."
Incidentally, as part of the whole process of the plea deal, Lohan had to turn herself in to police in Santa Monica for booking, then was promptly released. Her mugshot then hit the media, and definitely made for an interesting addition to her mugshot collection. The 26-year-old onetime child star definitely looked like she'd spent the night trying to go clubbing in L.A.
