Jury to continue deliberating in DUI crash that killed Angels pitcher
An Orange County jury is set to continue deliberations this morning in the murder trial of the man accused of killing an Angels pitcher and two of his friends. So far, the jury in the drunken driving case has deliberated for a little more than one full day.
The jury is considering two weeks of testimony in the case against 23-year-old Andrew Gallo.
He’s the San Gabriel man accused of second-degree murder, felony drunken driving and felony hit-and-run for the crash last year in Fullerton that killed Angels pitcher Nick Adenhart and two of his friends.
A fourth passenger suffered severe injuries but survived. That young man had to have his skull reattached to his spine.
Prosecutors paint Gallo as a careless guy who decided to drive after a night of heavy drinking, despite warnings during a previous DUI conviction that he’d be charged with murder if he killed anyone while drinking and driving.
Gallo’s attorney argued that he never intended to kill anyone and that he planned to have a designated driver.
She also told the jury that Gallo may not have been the driver, although outside the presence of the jury last week, the judge convicted Gallo of driving with a suspended license. That is a misdemeanor charge.
If the jury convicts him, Gallo could spend up to five decades in prison.
