'Sticky Fingers' Lohan More Scatterbrain than Mastermind?

Actress Lindsay Lohan's shopping habits might wind up proving she's a dizzy starlet and not a jewelry thief, if the tale of her near-theft of an earring from the same Venice store accusing her of stealing a pricey necklace can serve as help for her case. TMZ explains that four days prior to the necklace disappearing incident, Lohan was browsing Kamofie & Company, and tried on a pair of diamond earrings. She removed one, but left the other in, which was covered by her hair. The clerk stopped Lohan as she made her way out the door. When she realized her gaffe, the actress reportedly laughed, and removed the earring. She was also headed out without something of hers: "She had absentmindedly left her own, more expensive earrings on the counter as she began walking out of the store with the single earring. And, people who know Lindsay say she's a scatterbrain who forgets basic things all the time."

Could this be how the necklace in question got out of the store? The dingaling actress has shown up in the past sporting goods that were thought to be stolen. Notes CBS2:

In January 2008, she was spotted in an $11,000 mink coat. The coat’s owner claimed Lohan took it from a New York club. Like the necklace in this case, the coat was quietly returned. Last April [...] Lohan was caught on-camera wearing a missing Rolex valued at $35,000.

No charges were filed, however, in those instances. How much jail time is handed out for being a "scatterbrain"?
