Two top attorneys who argued Bush v. Gore on opposite sides have now joined forces to strike down Prop 8 in federal court, filing for a preliminary injunction against same-sex marriage ban until the case is resolved, which would immediately reinstate the right for all Californians to marry. Theodore B. Olson and David will officially announce their case tomorrow morning in downtown, according to the American Foundation for Equal Rights.
Olson, a former U.S. Solicitor General represented President Bush, against Al Gore, who was represented by Boies. The pair is representing two gay men and two gay women who were denied marriages licenses because of Prop 8.

I'm so tired of hearing this incorrect argument. The Iowa Supreme Court allowed gay marriage (just like the CA Supreme Court did); it was the 52% of CA VOTERS who struck down gay marriage.
If Iowa put it up to a popular vote it wouldn't even be CLOSE, "no gay marriage" would win by a mile.
Ain't it grand when we put the rights of minorities up to a majority vote?

But then, Iowa is progressive enough not to put the rights of minorities up to a majority vote. Odd that Iowa can figure that out but California can't.
Yeah, not to mention, our Supreme Court basically just allowed the voters to change the state bill of rights on a whim. Other states, even with the ability to amend the constitution, still have certain limits on what can be changed. Not us!
I want to second this: The problem is that our state constitution is a contradictory, convoluted mess with more choke points than a NYC bondage club yet somehow, with an equally high number of ways a teeny tiny group of crazies can impose their will on everyone else.
I'd also like to reiterate for like the millionth time that pro-prop 8 organizations lied with spectacular profligacy, about the law as it stood and about what would happen if Prop 8 didn't pass, and also frequently violated the state and nation's laws regarding tax exempt entities and political activity. Meanwhile CA also has a remarkably large number of uninformed voters, and worst of all, the anto prop 8 crowd, we just didn't think it would possibly pass until it was too late.
