Prop 8 Proponents File Lawsuit to Invalidate 18,000 Gay Marriages

prop8invalidate.jpgProposition 8 proponents filed a lawsuit today seeking to nullify 18,000 gay marriages that took place between June and November this year. The brief filed with the court was co-written by Pepperdine's law school dean Kenneth Star, who also was the former independent counsel that investigated President Bill Clinton. "Proposition 8's brevity is matched by its clarity. There are no conditional clauses, exceptions, exemptions or exclusions," it read.

Attorney General Jerry Brown promptly responded to the filing in a statement this evening. “Proposition 8 must be invalidated because the amendment process cannot be used to extinguish fundamental constitutional rights without compelling justification.”

I don't think there's any doubt those marriages were valid at the time they happened. Annulling them seems very unlikely, though it may take many years in the court to prove it. I think the issue will become moot before it came to that.

This is a good thing. It needs to be challenged in court, and the more they push the issue, the more they'll look like idiots and hopefully this will get overturned before long.

One can hope, at least. Though I suppose I can't be too sure considering it got passed in the first place.

I can't wait to learn how Ken Starr is gay. All of this right wing projection must mask some deep rooted self-hatred.

Too late, the idiots running around defacing churches and standing on police cars, in support of the No on 8 already over campaign, got that covered.

Jerry Brown is simply following suit with the other Dem governor candidates, Frownstein and Villaingoawaysa, and hopes to pimp gay dollars. He knows that legally and constitutionally Prop 8 can not be overturned, since it is an amendment to existing law.

Remember Hillary Clinton, she is the wife of husband, Bill Clinton, who supported and signed the federal DOMA-Defense of Marriage Act.

Yet, all of the bigoted and hateful acts are done by the No on 8 crowd. LIke for instance, out of petty mindedness, they want to boycott El Coyote over $100, when that restaurant has pumped millions of dollars in employing gays and community tax dollars.

I am sure that when they suspend or revoke your driver's license, you would say the exact same thing. It won't matter, because it will not be valid.

You do not have a federal argument, because the federal DOMA says no same sex marriage or civil union in any state is valid or recognized by the federal government.

People, there is no changing the minds of these hateful, tiny little people. None whatsoever. Even engaging with them to insult them is a waste of your time. These bigots are not interested in dialogue, they simply want to provoke people with a capacity for actual human decency into apoplectic rage at the depths of their ignorance and miserly minded meanness, so they claim that it's actually the opponents of prop 8 that are the true bigots. That is their only goal.

You will not be able to say anything to them that will change their minds or make them see gay people as human beings deserving of rights and equal consideration under the law. No point in engaging people. Ignore them.

As I've proposed elsewhere, every time one of these wonderful, love giving, Christ-like people post a bigoted anti gay and anti liberal screed, we should simply list our favorite holiday songs in response.

Rights? Last I looked, one nice gay fellow was making the point, that it was gays cooking our dinner, making our clothes, serving us our food, decorating our houses, etc. Sounds like equal employment.

Another person suggested that gays are smarter and get paid more money. Funny thing, I guess he his saying that women and Blacks are not smart, because they defintely get paid less.

I have yet to hear one of these so-called people, who claimed to be desirous of intellectual dialogue, explain what makes them the exception.

Do you think that you are better than other people who must follow the marriage laws.

Marriage Laws in General:
1. You must be 18 years old, so we can discriminate against does who have not reached that age.
2. You must have the mental capacity, so we can discriminate against the retarded.
3. You can only marry one person at a time, so we can discriminate against the polygamist.
4. You can not marry your sibling, so we can discrimiante agsisnt siblings that fal in love.
5. You can not marry your child, so we can discriminate against incestuos fathers.
5. Gosh, you can not even get marry in the U.S. if you are a citizen of Mexico and not the U.S., so that is okay as discrimination goes.

Must makes you so special? What makes your love more special than theres?

My answer is easy, I lump you all together, and so does the law.

I think for me it is a toss up between, "All I Want For Christmas Is You" and "Feliz Navidad". Although personally I'm not much into holiday tunes, especially when they start playing in store speakers starting around the day after Halloween.

BTW, I'd like to *strongly* recommend that everyone look up a record called "A Very 8-bit Christmas", by mafialigator. There's three volumes now, all available for free downloads. Basically, they're 8-bit OG Nintendo style versions of classic xmas songs, and they're incredible.

I do have to disagree on one thing - I love holiday music, and kind of wish the xmas season could begin in september. Only if the weather accompanied it though.

By the way, in regards to the marriages being valid, they are only vaidl if the licenses are valid.

Take legal drinking ages, which vary from state to state. If you were of drinking age is Georgia at 19 and moved to California where the age is 21, you can not drink.

Also, since the federal DOMA mandates that no state need recognize the civil union or same-sex marriage of another state, it also applies that the same state need not recognize married people who are deemed to have invalid licenses and that the U.S. government never recgonized.
