As part of his executive order mandating water restrictions, Gov. Jerry Brown directed water authorities to discourage waste by charging higher rates for heavy water users. But the legality of the pricing model is currently in question.
The Los Angeles Times reports that the suit alleges San Juan Capistrano's tiered water-rate structure violates state law. At least two-thirds of California's providers, including the Los Angeles Department of Water and Power, use some form of tiered rates.

Many water agencies already bill this way, because tiered rates can encourage conservation. But the legality of the pricing model is currently in question. 

Orange County Register reporter Meghann Cuniff joined Take Two to talk about the local dispute over tiered water pricing in San Juan Capistrano that could have implications for other water agencies throughout the state.
