Changes in the Three Strikes Law
Last Thursday, the U.S. 9th Court of Appeals court struck down two lengthy sentences imposed by California's three strikes law. In a 3 to 0 ruling, the court stated that a sentence must be proportionate to the last crime committed, thereby making a 25-year-to-life term for petty theft cruel and unusual punishment. Larry Mantle discusses the ruling and its effect on the State's three strikes law with Bob Pugsley, professor of law at Southwestern University School of Law.
