For the first time in 30 years the Supreme Court will consider broadcast decency standards. A 2004 FCC decision that even a one-time use of an obscenity on broadcast television and radio violates decency standards resulted in a reprimand of Fox Broadcasting. The networks subsequently sued, and the 2nd Court of Appeals said the FCC's policy sanctioning "fleeting expletives" infringed on the 1st amendment. Now the Supreme Court has decided to hear arguments in the case this fall.
