This Means War: Woman Accuses Former Partner of Stealing Trade Secrets from Her Cupcake Sleeve Business

There's a brutal battle heating up in the cutthroat world of cupcake sleeves.

In one corner there is Sheri Mersola, who founded a business that goes by the name Roundabouts that sells sleeves that wrap around cupcakes to make them look like everything from a hamburger to a popcorn tub to a basketball. In the other corner is Mersola's family friend and former Roundabouts director Theresa Deliberto, who later sold her share of the company and started her own business. Her new company Cupcake Cuties also sells sleeves that wrap around cupcakes that make them look like everything from a hamburger to a popcorn tub to a basketball.

Both of them went on morning shows to show off the goods—Mersola did a demo on KCAL, and Deliberto did one on Good Day LA. Both of them claimed to have come up with the idea. Deliberto said she came up with the idea after she realized she was wasting her life away trying to make cupcakes like the other moms: "I would spend hours and hours making cupcakes and I thought there had to be a better way."

Now the former friends and business partners are duking it out in court (unfortunately, we couldn't find a picture of a gavel-shaped cupcake for the occasion). Mersola is suing Deliberto for fraud, misappropriation of trade secrets and breach of contract. A judge today agreed to allow the case to move forward, according to City News Service. Mersola claims that Deliberto used customer lists, business methods and supplier information to advance her own company.

Mersola is asking for damages as well as an injunction so no one confuses the two companies. Finally, she is demanding that all wrappers and items with the name Cupcake Cuties "be delivered up and destroyed."
