The driver who killed a family of 5 on their way to Disneyland in May is reported to have been on prescription drugs at the time of the crash.

Joshua Smith, 30, passed out behind the wheel of his van in Hesperia after taking prescription drugs on Sunday, May 11 around 7 a.m., the Fresno Bee repots. His car veered into the wrong lane and crashed into a Honda sedan that was stopped at a stop sign.

The van flipped on top of the car and killed Angelica Garcia, 25; Geraldo Jimenez, 30; Garcia’s son Freddy, 9; and the couples’ two children, Cindy, 3, and Ivan, 2. The family had been on the way to Disneyland to celebrate Cindy’s fourth birthday. Smith sustained only minor injuries.

Police have not released the name of the drug found in his system, and it has not been decided whether charges will be filed against Smith.
