Schwarzenegger on Prop 8, Obama on Domestic Partners Benefits

As this week marked the bittersweet one-year anniversary of legal gay marriage in California, two political leaders made big moves in the advancement of gay rights. In California, Governor Schwarzenegger on Tuesday decided not to defend the constitutionality of Proposition 8, which banned gay marriage, in a federal court case. Disappointing traditional marriage advocates, he said it will be up to the courts to decide because the case "presents important constitutional questions that require and warrant judicial determination."

CA Gay Marriage: One Year Later

For California's gays and lesbians, today marks the bittersweet one year anniversary of the California Supreme Court's decision to allow LGBT folks to get married in the Sunshine State. Of course, things didn't turn out exactly as planned and in November, Proposition 8 passed, leaving gays and lesbians high and dry at the aisle. Cue the scenes of protesters marching on the Mormon Church, the streets of Silver Lake and Downtown and ultimately, last month's decision by the Supreme Court to uphold Prop. 8 while allowing the approximately 18,000 couples who were hitched to stay that way.

Bound to happen, right? Nevertheless, it's pretty funny.

It didn't take long for the LA County Registrar-Recorder/County Clerk to take action yesterday evening. A notice from their office was sent shortly after 6:00 p.m:

Opponents of Proposition 8, the ballot initiative that sought to eliminate gay marriage in California, haven't conceded that they have been beaten yet. Today a petition was filed in the California Supreme Court and a large amount of ballots are reportedly still unaccounted for.

The suspect and the victim's stories differ, but one fact remains: an openly gay man was attacked with a "Yes on 8" sign. Prop 8, which seeks to eliminate gay marriage in California on next week's ballot, is the most contentious and watched ballot initiative across the country. 23-year-old Joseph Strom is due in Torrance Superior Court today for the Sunday night attack that sent the 22-year-old victim to the hospital with a inch long gash on his head.

Fourth of July celebrates the signing of the Declaration of Independence. But today, 221 years ago back in 1787, the Constitution was signed (read the full text here). We don't really celebrate it, but "it was only four years ago that Congress passed a law mandating the celebration of Constitution Day, at least by schools and federal agencies," said the San Francico Chronicle, who has a fun little quiz about the Constitution. One relevant question to California: "If a gay couple married under the laws of California moves to Kansas where gay marriage is not recognized as legal," then...

"As a state, I believe we should uphold the ability of our friends, neighbors and co-workers who are gay and lesbian to enter into the contract of marriage," said California Sen. Dianne Feinstein in a statement about Proposition 8, that November ballot initiative that seeks to ban gay marriage in California.

There's nothing particularly scathing in this letter asking for Prop 8 support, but as blogger John Remy at Mind on Fire points out, he was only sent this letter because he's on the Mormon Church's official ward roster.

“This lawsuit was more about politics than the law. The court properly dismissed it,” California Attorney General Brown said today about a lawsuit challenge about the language that will appear on November's ballot over gay marriage. A judge today dismissed the challenge and said the language is fine. Proponents of Prop 8 wanted the prop to be described as a limit on marriage, but after gay marriage was legalized in June, the Brown changed it to reflect just that: "Changes California Constitution to eliminate right of same-sex couples to marry. Provides that only a marriage between a man and a woman is valid or recognized in California."
