Court Presses Pause on Prop. 8 Trial Video Release

Same-sex marriage supporters have been advocating for the public release of the Proposition 8 trial video recordings to show the evidence behind former Chief U.S. District Judge Vaughn R. Walker's ruling that overturned the 2008 ballot measure. On Monday, a federal appeals court placed a temporary hold on the decision to go public.

Earlier this month, Chief U.S. District Judge James Ware ruled to release the videos to the public. A trio panel of the U.S. 9th Circuit Court of Appeals says Ware's ruling may not be enforced and depends on a decision by the appeals court.

Gay marriage opponents also oppose publicizing the videos. They feel that witnesses who testified for Prop. 8 backers could fall victim to harassment.

An accelerated schedule for written arguments and a hearing has been slated for December 5.

  • "witnesses could fall victim to harassment"?

    Horseshit!  If anyone testifies in court (especially on a matter that speaks to their beliefs) then they should have no problem defending their convictions to anyone. 

    Since these witnesses fear "harassment", that tells me they knew what they were saying in court was harmful and offensive - Release the footage!
