Man Arrested After Spitting at Latina, Telling Her to 'Go Back to Mexico'

A man has been arrested after he allegedly spit in the face of a Hispanic woman, then tried to run her down with his bike.

The OC Register reports that 31-year-old Jonathan Michael Schmidt, who's white, rode his bike up beside his 36-year-old victim's car in Huntington Beach as they pulled up to a stop sign at 1:40 p.m. on Monday. He reportedly began yelling racial slurs at her and her sister, who was in the passenger seat. L.A. Now reports that he shouted profanities, and then "Mexican, go back to Mexico.”

Schmidt then allegedly spat at the driver through an open window. The whole thing was reportedly totally unprovoked.

After Schmidt rode away, the women continued driving and pulled into the parking lot of a shop. They got out of the car when Schmidt showed up again, and rode his bike directly at the two women, causing them to have to jump out of the way to avoid being hit.

Schmidt was arrested at the scene, and is being held on $50,000 bail. He's charged with two felony counts of hate crime battery and one felony count of hate crime, and is expected to be arraigned tomorrow.

  • The funny thing about this report Is how they state that he is WHITE, the report seems to be racist itself since it does not really know what race he is because his mother and father are mexican themselves. through ancestry he happens to have a German last name. Typical miss reporting to make the story intresting and the crime to be magnified!

    Really we're going to give him the benefit of the doubt as a cyclist?

    As a pedestrian constantly dealing with rude cyclists acting like they own the sidewalk I'm getting so tired of the complaining.

  • This times 100. The vast majority of cyclists on the road figure they should be able to ride on the street while ignoring traffic signals (or one way streets) but also ride on the sidewalk whenever they want as long as it's convenient for them.

  • Unfortunately, if this racial rant and spit attack was provoked by the
    Latina's, the guy is fucked.  Once someone reports an incident like this to law
    enforcement they are automatically considered "the victim" and the other
    party "the perpetrator".

    I had a similar incident happen to me a few years ago.  Thank god this guy did not have someone with him because the story he told police was a COMPLETE lie.  Long story short, the case was kicked down from D.A.'s office to City Attorney and did not go to court. 

    Moral of the story:  If you find yourself in a spat of road rage, take a breathe and count to ten.  If it was an honest mistake, no harm no foul and you should not further risk your life or safety.

    Even if it was "provoked", going after someones race in a fight is just stupid. I can get pretty heated, and yes even ridiculously over-the-top, making (empty) death threats angry, but even I know that attacking someone over something they can't control (like race) is pathetic. Not only that, it can get you catch all sorts of hell for that. Trouble that's a fucking nightmare to deal with. (Lest we forget: michael richards, etc...)

    Ok, michael richards is a bad example but I still say this guy probably had strong hateful feelings toward latinos way before this incident. Being that this took place in huntington beach, I'm pretty confident he was sheltered enough to think he could get away with it. I grew up in north oc and knew there were a lot of pockets of white supremacy in HB.

    So basically, I'm not buying this spur of the moment anger motive. I think he's had these racist feelings and any provocation from a latino person gave him enough cause to open his pandora's box of hatred.

    I definitely don't actually agree with the racial slurs (especially being a Latino myself) - I'm just saying I can see this being provoked from a car vs bike standpoint. Not agreeing with *anything* the guy did - I'm just saying it doesn't surprise me.

    Which is why I don't do anything, because most drivers don't even see me and will keep driving. Or they'll notice after the fact and will just assume I'm some crazy man on a bicycle. If they do stop and see me - I give them the "wtf" look and *usually* they realize their mistake, wave, and continue on. Which is about the best I can hope for, people realizing "oops - probably should've have done that" and hope that they'll be more aware next time around.

    I'd like to hear his side of the story - it's possible this WAS provoked - even if unintentionally. I say this because he pulled up on his bike to them - which means they passed him at some point.

    I don't know if people here ever ride bikes, but we're constantly subjected to cars either passing aggressively too close to us because they are annoyed that we are on the road, or they are just oblivious to the fact that people actually ride bicycles that share the road. It wouldn't be so hard to imagine that this driver inadvertently did something that scared the bicyclist, which in turned caused him to be incredibly enraged.

    Just 2 months ago I saw a lady - completely oblivious to someone walking across a building exit - almost hit him - and he got so mad, HE spat in her open window before she peeled off. Her face was indifferent throughout the entire thing - until he spit on her. Like it was HIS fault for being in the sidewalk while she illegally did not stop.

    And since I'm almost run over on a daily basis because people do the same thing (drive too close, don't stop) - I can see how some people would react this way. Of course my reaction is a simple stare down or a "what the f??" look if they even notice me.

    The racial slurs was a bit much though...but again, if you're almost run over, people do lose their mind.

  • The right thing to do is write down the license plate number, description of the driver and make a police report.  This way you look like the good guy and your actions may actually have a positive effect for other bikers.

    The wrong thing to do is get pissed off, spit in somebodies face, shout racial slurs and try to hit them with your bike.  This just makes you look angry, stupid and racists.

    When others read this story or see this happen on the street they look at it as just another case of bicyclists being jackasses and in the future they may be less likely to make room for you on your bike.

    Trust me, I know that there are good and bad bicyclist out there, and I regularly ride my bike.  I'm not one of the idiots that think bicycles shouldn't be on the streets.  I'm a considerate driver like most out there, but I understand that there are idiots behind the wheel.

    As a bicyclist you take your life into your hands when hitting the streets.  The laws are there to protect you but when something goes wrong it's your ass that gets hurt or killed.  My point is to ride defensively and pretend everybody is out to kill you, just as motorcyclist are trained to do.
