
Pulled over for a traffic stop around 12:40 a.m., Kerry failed a field sobriety test, but refused to take a preliminary alcohol screening test in the field, leading to her arrest and booking at the local area station.
"Cops took her to the station and then conducted a formal blood alcohol test which showed a level of .06," explained TMZ. "Under California law, the legal limit is .08, but a driver can still be prosecuted -- even under a .08 reading -- if the vehicle is being operated unsafely due to alcohol."
She posted a $5,000 bail and was released around 5:25 a.m. Kerry, who is the oldest daughter of Massachusetts Senator John Kerry, is a film producer and director.

i suspect she always drives recklessly; it's just there happened to be some alcohol involved this time when she happened to get stopped. that's the haps, man.
Why the long face?
She must have the same long windedness/gift of gab like here dad. She was able to filibuster the cops until her BAC was under the limit.

She may have had a few drinks, but she did exactly what DUI lawyers advise their clients to do. Don't take the field sobriety test, it is not required. Of course they arrest you, take you in and book you. Then you wait around until they come in with an "official blood alcohol" testing kit. You have to take that test. By that time your blood alcohol level has decreased significantly. She register .06. Unless she was driving like a maniac or blew threw red lights, the DA isn't going to prosecute for DUI for a .06. She'll probably get a ticket for whatever traffic violation they pulled her over for initially.
