A video of a San Bernardino police officer striking a man with his baton multiple times as he lays on the ground with another officer on top of him has surfaced on the net and has been picked up by TV stations.
Apparently, Darren Johnson, 43, was pulled over for running a stop sign and traffic signal on Monday night around 10:30 p.m.. Johnson pulled over in a 7-11 and at some point when talking to officers, he struck one of the officers. A scuffle began and that's when a customer inside the store came out and began filming the incident.
In the video (see it below), it appears officers are trying to get Thompson to turn over onto his stomach. He could be refusing or he might having trouble turning over as he tries to avoid the baton hits, which police usually describe as "distraction hits."
Johnson was arrested for the traffic violations, resisting arrest, assaulting an officer and possession of cocaine. He also underwent surgery for a compound fracture of his hand on Thursday.
Because Johnson was sent to the hospital and not booked within 48 hours, his lawyer says he should be set free. "He has certain constitutional protections that everyone is afforded and those were not given to him," Gary Wenkle Smith said. "You cannot take a person off the street and keep them from lawyers, from family, and deny information. This is not the kind of conduct we expect from modern-day law enforcement."
