Attorney General Will Not Investigate Former OC Assemblyman After Sex-Talk Tapes

Former Assemblyman Mike Duvall (R-Yorba Linda) is off the hook in at least two investigations after a video revealed to the public showed him bragging about sex with women, one of whom was allegedly a lobbyist. Last week the Assembly's Ethics committee dropped an inquiry into the allegations because they lacked authority over the matter once Duvall, who is married, resigned from office.

Then yesterday, Attorney General Jerry Brown's office said they will also not investigate Duvall because he "did not break any laws," according to the Associated Press. Nonetheless, the FBI has been looking into the matter, but no official investigation has been launched.

An earlier version of this story indicated that the Ethics committee was "forced to drop" the inquiry into Mr. Duvall. In fact, they dropped it after the Legislative Counsel's office came back with a legal opinion that found the legal options to prosecute Duvall are limited. "But that doesnt mean the issue is done," according to Jeremy Oberstein, spokesman for the committee's co-chair, Assemblyman Paul Krekorian.

Duvall never admitted to having an affair or not, but said his "offense was engaging in inappropriate story-telling."

A special election will be held for Duvall's seat on November 17th. Yesterday was the deadline for candidates to quality for the ballot.

"Did not break any laws", Jerry?

Duvall was on the energy committee, the lobbyist he was banging worked for Sempra Energy. At the very least that's a major conflict of interest. If it's proven he was getting sex in exchange for a vote or favorable legislation for Sempra, that's called bribery.

Jerry, if you want my vote for Governor you best grow some cajones!

hey AG, what are you? some kinda wuss?
getting into bed with the lobbyist is not violating ethic rules? if you're not investigating then how would you know if no criminal act was committed.
