It's been more than a year since a proposal to ban smoking in outdoor dining areas was brought forth as an idea. Now, the City Attorney's office has written the draft ordinance, which is scheduled to be reviewed tomorrow by a City Council Committee.
The ordinance would "not just cover the typical outdoor dining area, such as a restaurant's or hotel's outdoor patio," explained City Attorney Rocky Delgadillo in a letter to councilmembers. "It also includes outdoor food courts, which may not be controlled by any of the nearby businesses providing food or drink. It also includes such businesses as food kiosks, food carts and mobile food trucks by defining the dining area as within a thirty-foot radius of the business."
However, smoking around bars and clubs and at private events will be allowed under the ordinance. Also, a person briefly passing by will be able to legally smoke. The full text of the law is embedded below:

This is a violation of property rights.
why should i have to drive to culver city, burbank, or santa monica to enjoy outdoor dining without the smoke? exposing me and my family to secondhand smoke is a violation of our HEALTH rights. outdoor dining patios have been the de facto smoking section for too long. what a breath of fresh air!
