Unfortunately, they're only arguing whether or not prop 8 constitutes a constitutional amendment or a revision, whether it violates the separation of powers clause in the constitution, and what to do about the people who got married if it is in fact deemed an amendment. Not whether marriage should even be validated by the state at all.

Well yeah, they could have gotten Jerry Brown but he refuses to have anything to do with this circus. The official statement from the Attorney General's office is that the vote on prop 8 should never have happened and that validating it will encourage others to attempt to alter civil rights for minority groups in this way.

These No on 8 lawyers are horrible. Their presentation style is making me cringe. Even if they had strong arguments, this goes in the face of all accepted common etiquette of a Supreme Court hearing.
The judges are there to challenge your opinion because it is their job. Yelling back and being snippy irritates the judge, puts you out of favor, and greatly hinders your credibility.
One can say they put more pressure on Starr and he stayed calm, overly polite (a tradition in these hearings), responsive, and approachable.
This was really bad, I don't see much hope on the side of No 8, as much as I'm still crossing my fingers for them.
I'm sure this is in the works, but could you post an overview of what went down with the hearing?
I didn't get a chance to watch the live feed, but am interested in knowing what each sides definitive arguments were. And the Justices initial reactions.
