Dear Woman Killed in Christmas Eve Massacre, You Owe Rent

santa_shooting_rent.jpg Talk about disturbing: "Broadcrest Foothill Apartment Homes claims Alicia Ortiz broke her lease on an Upland apartment when she and her 17-year-old son were killed by her sister's disgruntled ex-husband. The landlord informed her former husband, Carlos Ortiz, that she gave 'insufficient notice to vacate.' The company says it is owed $2,821 in rent and penalties," reports the Associated Press today. And it's not just some oversight or a situation where they didn't know what happened, finds the Daily News. Worst of all, the property manager and the company won't even comment.

Renters read your agreement in the nicely tuned fine print you'd be suprise what you are liable for.

Death is not sufficient notice, legally, and if the next of kin is of age, or worse yet a co-sgnor, he or she is responsible.

That's right trojie. Dying horribly is NO EXCUSE for not giving her landlord proper notice that she would be getting killed and thus be unable to fulfill her lease obligations!!

Not sure why this is surprising. When people die their bills don't just vanish.

Someone has to pay and it's normally the family members.

Well, unless it's unsecured debt, like students loans or credit cards.

But mortgages, car payments, etc have to be paid. Who is her next of kin and why didn't they immediately contact a lawyer about all this stuff?

most people don't have money to consult a lawyer. Especially up in the inland empire and high desert. People get screwed real easy.

Meanwhile, right or wrong, legal or illegal, this company just bought themselves a hilarious PR disaster. I predict that because they're too fucking cheap to write off 2 grand, they'll end up spending 20 grand to make this go away.

Once again proving that capitalists are the smartest people in the room at all times...

I don't think they're going to spend 20G to get out of this.
If their lawyers did their homework then they have just cause and are owed the money.
it sucks, and it probably isn't right, but this kind of stuff happens every day.
Just because you die doesn't mean your debts are wiped clean.
Some one has to pay... someone ALWAYS pays.

Yea Trojie, I'm sure she got herself killed just to annoy and inconvenience her landlords and try to screw them out of $2,821 in rent and penalties.
