Opponents of Proposition 8, the ballot initiative that sought to eliminate gay marriage in California, haven't conceded that they have been beaten yet. Today a petition was filed in the California Supreme Court and a large amount of ballots are reportedly still unaccounted for.

"The petition charges that Proposition 8 is invalid because the initiative process was improperly used in an attempt to undo the state constitution's core commitment to equality for everyone," reported the Sacramento Bee today. "Kate Kendall, executive director of the National Center for Lesbian Rights, said 3 million to 4 million ballots remain uncounted statewide."

Proposition 8 passed with over 400,00 votes, according to California Secretary of State records.

On myspace a bulletin is circulating saying that there is a NO on 8 protest being organized for tonight around San Vicente and Santa Monica...

Yes. I can confirm that this protest is taking place. "Festivities", if you can call them that under these circumstances, begin @ 7pm.

Exit polls in California found on prop 8 that 70 percent of black voters backed the ban. Slightly more than half of Latino voters, who made up almost 20 percent of voters, favored the ban, while 53 percent of whites opposed it.
