Steve-O, Apartment Law & Smoking

California Law may let landlords say 'no' to smokingThere are a few things you can't do in apartments. There are things that you can't do anyway, like drugs, but you also can't break holes in the walls unless you own the place. Well, that's what Jackass star Steve-O did this weekend before his neighbors placed him under citizen's arrest, then turning him over to police, who in turn searched his apartment and found drugs.

And if his drugs are of the smoking kind, that may be soon banned, even the legal smokes. A Valley State Senator, Alex Padilla (you may remember him from LA City Counil) has put in SB1598, a bill that "would allow - although not require - landlords to ban smoking inside rental units as a means of protecting the health of other tenants who may live nearby," according to the Daily News.

Some say the law already exists on the book, but landlords feel it is too vague, leaving them open to easy lawsuits by tenants if acted against. Opponents of the bill say it could be used as an easy excuse for landlords to evict tenants, and wouldn't they love that, with rent control and all keeping them from raising certain people's rents.

As for Steve-O, it looks like he may be getting evicted soon.

My landlord (a balcony chainsmoker) has taken to serving us all with three-day notices at 12:01 am on the 2nd of the month. Like most LA apartment complexes, a lot of my neighbors smoke outside, while pot smoke drifts out of at least 8 different apartments.

My landlord recently posted a notice that there was to be no smoking indoors OR outdoors. Is that legal? It seems a little extreme to me...

Personally, as someone who's very sensitive to cigarette smoke, I'd love to live in an apartment building that banned all smoking. Fortunately it hasn't been a problem for me here, but I lived in an apartment New York with a chain smoker next door. I don't know if it's because the ventilation was bad or because this woman smoked so much there just wasn't any more room in her apartment for the smoke, but regardless, my apartment smelled like a smokers' apartment.

My friend lives in the same hallway as Steve O, a few feet from the whole incident.... we've been watching the chaos unfold for weeks. Its a total neighbor VS neighbor BATTLE....This arrest was immenent.

The arresting incident... SteveO bashed a hole in the wall, exposing the enemy's living room... and then put a big ass speaker inside the hole, blaring rap music into the dude's apartment.


Rent control activists need not fear anti-smoking ordinances.

The bulk of the just-cause evictions allowed under LA City rent control DO NOT ALLOW the rent to be raised.

A law permitting landlords to evict inconsiderate smokers would be treated in the same manner, and would not be undertaken lightly, as eviction costs owners real money.

He's being evicted today... SteveO trashed his apt last night...bashed his microwave, ceiling fan, windows, fired a gun at his own head, set his crotch on fire! He was having an 'eviction party' at noon today. Knoxville showed up, wee-man and Jeff Tremaine are in there with some other people. Later they all came out, with Steve-o. They were looking up at the window to Steve-o's apt then left in 3 cars. I think they were planning what they were going to do, then left to go get supplies. I'm pretty sure they plan to set up a hot tub in the front and then jump out the window into the tub. Then toss a bunch of shit out.
