Interview with Dr. Dave, the Handsome Malibu Doctor

David Martorano The story was just too good to ignore: good-looking UCLA doctor allegedly hooking up with his thirtysomething supervisor and bopping around LA in a sportster breaking hearts, taking names, and then being sued for slander.

Meanwhile the doc was suing the world famous university for losing his job as chief resident once he had dumped the supervisor.

Yesterday a jury found that Dr. David Martorano who now has a private practice in Malibu, did not slander Dr. Heather Krell (best known for being Winona Ryder's shrink after the shoplifting case) by saying that they had an affair, and it found that UCLA did not remove Dr. Dave from his post as chief resident because of the break-up.

But we had lots of questions for the young doctor. The case involved getting oral love in the back seat of a sporty Audi, unidentified women telling sex stories in such detail that they had to use fake names in order to testify, and we wanted to know if UCLA psychiatry world had gone crazy with all these sexual harassment lawsuits flying around.

LAist: Even though you lost your case against UCLA, you won the case brought against you, so are you satisfied with the overall results of yesterday's events?

Dr. Martorano: I can't say I am satisfied. I think the Jury did the best that they could with the information at hand, and the wording of the law. Some critical information was excluded from the case, including that Dr. Krell had filed her other lawsuit, and other false claims she made and later retracted, the nature of which I am not sure I can legally disclose at this time. I was happy to the extent that the verdict clears my name. I don't lie, and I didn't lie then. The jury didn't believe Dr. Krell. I was surprised to read she felt "vindicated" after losing a slander verdict and learning that jurors, including Mr. Domenech, thought she lied. Apparently, she continues to be more concerned with not getting in trouble than with the perception that she committed perjury.

According to the Times, UCLA's lawyer, Alan Zuckerman tried to paint you as having a narcissistic personality disorder, going as far as listing nine points of the behavior and showing how you met all of them. What did you think of his attempt to discredit you in that way?

Actually, he skipped over two of the nine, and the board he presented did not actually say narcissistic personality disorder, it just said narcissistic, it also left off the explanation as to the nature of how the criteria must be met. I think it was a desperate act, but probably effective. The word narcissism appeared once in my analyst's notes, it was actually quoting me, looking at my own narcissism. We all have it. In response to your question, I would have preferred if the trial had stuck to the facts of the case. Alan's a great lawyer, and did quite a job on this case. He knew the facts of the case. As a society, we tolerate lawyers looking past the truth, and confining themselves to the argument at hand. I think that's unfortunate.

The Times said that your own personal psychiatrist said that you were "addicted" to having women fall in love with you. Isn't there doctor-patient confidentiality? Do you feel betrayed by your psychiatrist for saying that about you?

I don't think my psychiatrist said that, I never heard him give testimony to that effect during trial, I told [the LA Times staff writer of the piece,] Jessica Garrison to look into it, cause it appeared to be a misquote. It was something Krell's lawyer said at the closing argument. But if my psychiatrist had said that, I wouldn't care, there are worse things to be addicted to.

Is it common for psychiatrists to divulge their opinions about their patients?

Only with their patient's consent, which I gladly gave. I have nothing to hide.

How did your lawyers respond to Garrard's theory that Dr. Krell wouldn't have given you oral sex outside of her apartment "because a 35-year-old physician would obviously choose to go to her apartment rather than stay in the car"?

Well, since the jury, denied her claim of slander, 12-0 and there were 4 women and 8 men I would say that no one there bought into that or any of Mr. Garrard's other ludicrous suggestions. Which included claiming the Jury shouldn't believe me because, on one occasion I didn't remember where my ejaculate ended up. He quoted evolutionary biology and elaborated that we are programmed from birth to keep track of such things. Do you? Also, he stated that it was a physical impossibility to climb from the front of an Audi A4 to the back, and wanted to introduce evidence from an accident reconstruction expert proving his point. The judge didn't allow it, but my wife and I prepared by filming ourselves doing just that (climbing into the back seat of a 2003 Audi A4.)

If the trial was pretty much about you and Dr. Krell's relationship, why did other women have to testify about their sex life using code names in order to protect themselves?

Dr. Krell's attorneys subpoenaed the other women. I still don't understand what it had to do with the case, it was a tactic to distract. They were very uncomfortable, and I felt bad that they were there at all. I didn't subpoena any ex-girlfriends. All of the witnesses who testified on my behalf volunteered.

Is UCLA's Neuropsychiatric Institute a crazy place, ironically, in the wake of all the lawsuits being brought involving Dr. Krell, yourself, and others?

No, it's not a crazy place, most psychiatrists are a little offbeat. The press has really honed in on the salacious aspects of this case, but for me, it was really about being called a liar, and losing a position that would have given me a real head start on opening my psychiatric practice. Dr. Fawzy, the executive director decided to remove me from my position based on a rumor, that's ridiculous! And it didn't seem fair. Furthermore, as I testified, even though we were having an affair, no one else wanted or applied for the job, and no one took it after I left.

Also, it was never about getting her to admit we had sex. In fact, my wife has been ruthlessly teasing me throughout trial and she has feels Dr. Krell is "terminally ugly," having Krell admit to an affair was not a "feather in my cap." Even a juror approached me after trial and seemed perplexed as to why I had ever wanted a relationship with her. I don't remember exactly what he said, but it seemed that he didn't find her attractive either. Even I had to wonder what the hell I was thinking after I saw her in the courtroom. I can't say I find her even the least bit attractive, and am in fact repelled. My wife does an incredible imitation of her, and I have to beg her to stop. I find it that disturbing.

fyi, a resident is a doctor, not a med student.

Dr. Martorano just spent over two years suing UCLA and Dr. Krell for Sexual Harrassment and lost both of his lawsuits against them. Now Dr. Martorano believes he is vindicated solely because he may have had sex with a female. That was UCLA's theory of why Dr. Martorano filed his lawsuits in the first place, and it is very sad to think that hundreds of thousands of dollars and precious jury time was wasted just so Dr. Martorano could satisfy his ego, while losing both of his underlying lawsuits.

Dr. Krell felt vindicated because the jury did not believe that both she and UCLA violated the laws of Sexual Harrassment and that the lawsuits were based on baseless accusations.

I can't believe this guy is actually treating patients! I don't know who he thinks he's kidding-this is narcissism at its worst!!

Dr. Martorano spent almost 3 years suing both UCLA and Dr. Krell for Sexual Harassment. A jury of his peers just denied both of Dr. Martorano's lawsuits, and determined that no law had been violated by either UCLA or Dr. Krell. Dr. Krell was vindicated because UCLA had always believed that Dr. Martorano's lawsuits against them were derived from baseless accusations. UCLA also believes that Dr. Martorano suffers from Narcissistic Personality Disorder.
Judging from Dr. Martorano's feelings of being vindicated even after losing both of his lawsuits, leaves little doubt that UCLA was right about Dr. Martorano. It is a crying shame that hundreds of thousands of dollars and precious jury time was wasted just so Dr. Martorano could satisfy his ego while completely losing both of his underlying lawsuits against UCLA and Dr. Krell.

I know Dr. Dave. He is a very knowledgable Psychiatrist.
He is no different from the 20+ Doctors involved in this trial , he just made the serious mistake of going to court to plead his case.
That was dumb and risky. He lost personal respect and could have lost lots of bucks
Krell is a also a decent doctor though she mafde the cardinal error of becoming. sexually involved with her subordinates

The lawsuits that Dr. Martorano filed were for Sexual Harassment. UCLA and Dr. Krell prevailed against Dr. Martorano because his lawsuits were categorized as "Baseless Accusations".

Dr. Krell sued for $1, and Dr. Martorano had nothing other than his Ego to go to court with.

The jury and even Dr. Martorano's own investigator determined that UCLA followed protocol and did not violate the laws of Sexual Harassment.

Bringing these lawsuits against UCLA and Dr. Krell were not brave, they were tantamount to be completely frivilous.

Dr. Martorano actually stated that sex was forced upon him. The evidence at trial indicates that Martorano is sex addicted and loves to discuss his conquests. He has no credibility because his 3 year legal battle and defeat was categorized as "baseless accusations".
Even if there was a relationship between the two, it was both consensual and between two mature adults.
The thought that Martorano would cause close to a half million dollars in fees between all of the lawyers, investigators, expert witness', court fees, etc. speaks volumes in verifying that Martorano suffers from "Narcisstic Personality Disorder" rather than being a victim of sexual harassment.

Does anyone have information concerning the lawsuit against Dr. Martorano and his new wife for intentionally poisoning his neighbors dog in Malibu? I read that in both the Los Angeles Times and the London Times referred to that lawsuit in their coverage of Dr.Martorano.

why would you ask that question anonymously? what do you have to hide?

Well I'm the neighbor that those articles were referring to and I can honestly tell you that Dr. Martorano filed approximately 20 dog barking noise complaints against our beloved Golden Retriever. He even went as far as asking a court to order that our dog live indoors. When Dr. Martorano lost that court order, we found our dog dead in our back yard. We paid for an autopsy to determine the cause of death because we had immediately suspected foulplay. We received a toxicological report that categorically stated that our dog was poisoned to death. Dr. Martorano hated my dog because his normal barks would disturb his residential medical practice. Dr. Martorano would even hide in his kitchen while my two minor children would be playing in our backyard and he began to secretly videotape them(we have some of these sick and twisted video tapes) After we received proof that our dog was poisoned we filed our pending lawsuit. When Dr. Martorano was ordered to answer our complaint, he contacted child services and told them that my wife and I have sex with our children. The complaint was determined to be UNFOUNDED and child services concluded that they believed the call was made solely because of our ongoing litigation with Dr. Martorano. When we discovered Dr. Martorano's most recent lawsuit against UCLA had determined that he suffers from a mental disorder, we immediately knew that our family has been exposed to Narcissistic Sadism. Everything that I have just stated can be backed up with solid admissable evidence. The case is scheduled to proceed to trial in November and the case # is SC088846. We are seeking justice for our Golden Retriever Baily.

I am sorry to hear of your loss. As the owner of two labs, I know it is like losing a family member. This guy looks like a genuine dog-killer and anyone who files noise complaints with a sketchy past like his should be held accountable if he did the crime. Put it this way, I know the type both from living in Malibu, spending time being horribly beaten (almost to death) at UCLA Medical Center and having witnessed a neighbor friend lose two gorgeous Great Danes to a similar neighbor dog-killer situation (again, assuming he is guilty). This happend in Manhattan Beach and yes, it was the unstable neighbor who shot and killed the dogs. Horribly sad and to watch the one Dane "mother" the litter that my Dane sired, only to witness the sadness after the event was heartbreaking.

For what its' worth this guy should not be practicing medicine on anyone, in fact, Karma should make him a patient in his own institution. I have so much to say about this type......

He looks like the typical narcisstic db driving a red porche down PCH, you know the type, looking at himself in the mirror, wondering if anyone has just sent him a facebook love note........ winking at himself, smiling those bleached ivories. Total Barney and if found guilty, I hope he loses his job and reputation, whatever is left of it.

He probably comes home late at night just to read if anyone has commented on his creepy life.

May you win your case and get this guy removed from the 'Bu. What a dangerous pos. If he ever came close to my dogs, he would have a real problem. One bigger than his cheesy grin.
